Apex Media Solutions provides digital presence management services including, but not limited to, business listing management, reputation management, web design and development, social media management, and voice search activation. The specific scope of services will be outlined in your individual service agreement.

2. Eligibility

You must be at least 18 years of age to use our Site or engage our services. By using the Site, you represent and warrant that you meet this requirement and have the legal capacity to enter into a binding agreement.

3. Account & Access

Certain features of our Site, including the Client Portal, may require account credentials. You are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree not to use the Site in any manner that:

• Violates any applicable federal, state, local, or international law or regulation
• Infringes upon the intellectual property or other rights of any third party
• Transmits any harmful, threatening, abusive, defamatory, or otherwise objectionable material

6. Service Agreements & Billing

Engagement of our services is governed by the terms outlined in your individual service agreement. Key billing terms include:

• Plans are based on a 12-month commitment unless otherwise specified
• Setup fees may apply depending on the scope of services
• Service terms are outlined in your individual agreement — see our refund policy for details
• We accept Visa, Mastercard, American Express, and Discover
• All payments are processed through PCI-DSS compliant payment processors

We reserve the right to modify pricing with 30 days' written notice.

7. Cancellation

You may cancel your services at any time by sending a written request to info@apexmediasol.com. Cancellation will take effect at the end of the current billing cycle. Please refer to our Refund Policy for details regarding refund eligibility.

8. Limitation of Liability

To the fullest extent permitted by applicable law, Apex Media Solutions, LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Site or our services, including but not limited to loss of revenue, profits, business, data, or goodwill, regardless of the theory of liability.

Our total liability for any claim arising from or related to these Terms or our services shall not exceed the total amount paid by you to Apex in the twelve (12) months preceding the event giving rise to the claim.

9. Disclaimer of Warranties

The Site and all services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee specific results from our services. While we employ industry best practices and proven strategies, outcomes may vary based on factors beyond our control including market conditions, competition, and platform algorithm changes.

You agree to indemnify, defend, and hold harmless Apex Media Solutions, LLC, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from your use of the Site, your violation of these Terms, or your violation of any third-party rights.
